These Terms of Use govern the use of the cloud storage services provided by ASPEN TECH (CNPJ 32.534.156/0001-49), through the website and platform guarde.ai ("Service"). By subscribing to or using the Service, you agree to these terms.
1. Service description
guarde.ai offers cloud file storage (backup of photos, videos, and documents), with different capacity plans and monthly recurring billing, as presented on the plans page.
2. Registration and account
- You are responsible for keeping your account credentials confidential.
- The information provided must be true, complete, and up to date.
- Use of the account by unauthorized third parties is prohibited.
3. Plans, payment, and renewal
- Payments are processed by Asaas, our payment partner.
- Subscriptions are monthly and renew automatically until cancellation.
- The prices in effect are those displayed on the site at the time of purchase.
- You may withdraw from your subscription within 7 (seven) days of signing up, under Article 49 of the Brazilian Consumer Protection Code, with a full refund of the amount paid. To request a refund, email [email protected].
4. Cancellation
You can cancel your subscription at any time. Access remains active until the end of the paid period. After the paid period ends, your account will switch to read-only mode: you will not be able to upload new files or modify existing ones. You will be notified by email and have up to 45 days to export or remove your files; after that period, your data may be permanently deleted.
5. Acceptable use
Using the Service to store or distribute illegal content, or content that violates third-party rights or applicable laws, is prohibited.
6. Availability and limitation of liability
We make our best efforts to keep the Service available and secure, with redundant copies of data, but we do not guarantee uninterrupted availability or specific SLA levels. The Service is provided as is. To the extent permitted by applicable law, our liability for direct damages related to the Service is limited to the amount you paid in the last 12 months. We are not liable for data loss resulting from device failures, misuse of the Service, or force majeure events.
7. Changes to these terms
We may update these Terms periodically. Significant changes will be communicated through official channels.
